Marshfield Town Meeting Defeats MBTA Zoning Repeal, Approves Finance Director Post

Email Text Facebook X

MARSHFIELD -- April 28, 2026, Marshfield Town Meeting rejected a bid to repeal the town's MBTA zoning overlay district and approved a framework for a new finance director on the second night of the 2026 Annual Town Meeting. Articles 37 and 38, brought forward on a two-to-one Select Board vote by Selectman Eric Kelly, failed to reach the required two-thirds threshold after Town Counsel Robert Galvin read a letter from the Attorney General's Municipal Law Unit warning that repeal "would conflict with General Laws Chapter 40A, Section 3A's requirements," citing the 2025 SJC ruling in Attorney General v. Town of Milton. Resident Don Gibson urged defeat, saying the state "wasn't bluffing the last time" when it withheld grants from the town before the October 2025 compliance vote. Town meeting also passed Article 22 authorizing a home rule petition to create a finance director position, an unanticipated cost, opponents noted, for a town carrying a roughly $7 million structural deficit, along with a new capital stabilization fund, a contract extension bylaw allowing terms beyond three years, and $1,177,035 in Chapter 90 state highway funds. A Historic Commission proposal to expand demolition delay review to exterior renovations failed after Building Commissioner Andrew Stewart testified the bylaw as drafted would require forwarding all building permits, not just those for historic structures, to the commission. Financial articles including the fiscal year 2027 budget remain deferred to a continued session on June 15.
